This essay aims to examine the constitution of the Athenian archaic state based on some of the political and economic aspects that may have defined its earliest stages. However, on this occasion, the analysis also considers the available ancient news about Drakon. We would like to highlight that his contribution was not exclusively judicial but that it also involved other fundamental aspects of the definition of state. Thus, Drakon can be regarded as a "terminus ante quem" of the process which leads to the constitution of this state.
